1. Introduction and Scope

This Privacy Policy applies to the Balaur Data Extractor software application (Windows desktop, iOS, and Android) and the website at balaurdataextractor.com, operated by Balaur Data, Springwood, Queensland, Australia. We are committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Your Documents Never Leave Your Device

Balaur Data Extractor is a fully offline, local-processing system. Every document you photograph, scan, or import is processed entirely on your own device using Tesseract OCR, which runs locally. No document content, extracted data, or photographs are ever transmitted to Balaur Data servers. We have zero visibility into the documents you process.

Optional cloud fallback: If you enable the OCR.space fallback, document images may be sent to OCR.space for processing. You can disable this in settings. The Wi-Fi transfer feature operates entirely within your local network — no external servers are involved.

You are in control. Because processing is local, you — not Balaur Data — control all data produced by the Software. Balaur Data cannot access, recover, or modify your locally stored data under any circumstances.

3. Your Responsibilities as Data Controller

Because the Software is offline and local, you are the data controller for all personal information in documents you process. You are responsible for:

  • Ensuring you have lawful authority to process personal information in the documents you scan.
  • Complying with the Australian Privacy Principles and applicable state privacy legislation.
  • Securing, backing up, and managing all data extracted and stored locally by the Software.
  • Not using the Software to process documents in breach of third-party privacy rights.

Balaur Data accepts no liability for your use of the Software to process personal information of third parties.

4. Information We Collect

We collect limited personal information only in the following circumstances:

  • Subscription & payment — processed by Paddle, Apple App Store, or Google Play Store. We receive email address, country, and transaction references only.
  • Licence verification — licence key and device ID transmitted to Paddle for validation only.
  • Contact form submissions — your name, email, and message, processed via Web3Forms and delivered to our email.
  • Website hosting — Cloudflare may log standard access data (IP, browser type) for security and performance.

We do not sell, rent, or trade your personal information to any third party for marketing purposes.

5. Your Privacy Rights

Under the Australian Privacy Principles, you have the right to access, correct, or request deletion of personal information we hold about you. To exercise these rights or to make a complaint, contact us at hello@balaurdataextractor.com. If you are unsatisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

TERMS OF SERVICE

1. Acceptance of Terms

By downloading, installing, activating, or using the Balaur Data Extractor Software or Website, you agree to be bound by these Terms. If you do not agree, do not use the Software or Website.

2. Subscription and Payment

Access is provided on a monthly subscription basis. All plans provide unlimited document processing with no per-document, per-page, or credit-based limits. Subscriptions renew automatically. You may cancel at any time through your Paddle account or App Store / Play Store subscription settings.

We reserve the right to change prices with reasonable notice. Price changes apply to all subscribers from the next billing period — there is no grandfathering of legacy pricing. No refund is provided for unused portions of a billing period, except as required by Australian Consumer Law.

3. Licence Grant and Restrictions

We grant you a limited, non-exclusive, non-transferable licence to use the Software on the number of devices in your plan, for your internal purposes only. You must not:

  • Reverse engineer, decompile, or attempt to extract source code from the Software.
  • Share, sell, or sublicense the Software or your licence key to others.
  • Use the Software on more devices than your plan permits.
  • Use the Software to provide a commercial bureau or processing service to third parties without a separate enterprise agreement.

4. Your Responsibilities

Because the Software is offline, you are solely responsible for the content of all documents you process, compliance with Australian privacy law when processing third-party personal information, the security and backup of all locally stored data, the accuracy of extracted data before you rely on it for any business purpose, and the security of your local network when using the Wi-Fi transfer feature.

You must use the Software only for lawful purposes. You must not use it to commit fraud, process documents without authority, or breach any applicable Australian law.

5. Intellectual Property

All Software, including source code, algorithms, ghost overlay alignment system, word chip classification system, and associated materials are the exclusive intellectual property of Balaur Data, protected by Australian copyright and patent law. A provisional patent application covering 18 claims has been filed. You retain ownership of all documents you process and all data you extract.

6. Australian Consumer Law

Our Software comes with consumer guarantees under the Competition and Consumer Act 2010 (Cth) that cannot be excluded. Nothing in these Terms limits your rights under Australian Consumer Law.

7. Limitation of Liability

To the maximum extent permitted by law, Balaur Data is not liable for indirect, consequential, or incidental damages, errors in OCR output, loss of locally stored data, or any business loss arising from use of the Software. Our total liability for any claim shall not exceed the subscription fees you paid in the three months preceding the event giving rise to the claim.

You are solely responsible for verifying the accuracy of extracted data before using it for any business, financial, or legal purpose.

8. Governing Law

These Terms are governed by the laws of Queensland, Australia. Disputes shall be subject to the jurisdiction of the courts of Queensland and the Federal Court of Australia. The parties agree to attempt good-faith resolution before commencing legal proceedings.

9. Changes to These Terms
